Heard learned counsel for the petitioner, Ms. Ritika Kushwaha, learned counsel for the respondents no.4 and 5 and learned Standing Counsel for the State Authorities.
The petitioner has prayed for the following reliefs:-
"A. Issue a writ, order or direction in the nature of mandamus commanding to respondents authority to make a payment of arrears to petitioner for the construction work done as mentioned in the work order dated 23.10.2013 with interest prescribed by law or pay at present rate of work immediately within stipulated time fixed by this hon'ble court.
B. Issue a writ, order or direction in the nature of mandamus commanding to the respondent no.-2 to pass appropriate order in accordance with law on the application dates 9-3-2018.
C. Issue a suitable writ, order or direction commanding to the respondents authority, which this hon'ble court may deem fit and proper under the facts and circumstances of the case."
At the very outset, learned counsel for the petitioner does not press the first prayer i.e. A in the writ petition and confines his arguments with regard to the prayer B and C.
The claim of the petitioner is that he was a registered Contractor known by the name of M/s Dau Ji Traders. He was black-listed by an order dated 29.4.2015, which was challenged by means of Writ Petition No.61029 of 2015. That writ petition was disposed of by order dated 21.8.2017 holding that the order of black-listing was passed without giving any opportunity of hearing to the petitioner, therefore, the authorities were required to pass a fresh order after giving opportunity of hearing to the petitioner.
According to learned counsel for the petitioner after the aforesaid order till date no fresh orders have been passed.
The writ petition is disposed of with the direction to the respondent no.2 that in case no fresh orders have been passed after order of this court dated 21.8.2017, fresh orders be passed in accordance with law after giving opportunity of hearing to the petitioner within two months from the date a certified copy of this order is presented.
