Ms.Shah, learned APP waives service of notice of Rule.
The present application has been preferred by the applicant - convict for temporary bail on the ground that he wants to make construction of his house.
It appears from the jail report that for the very ground, the convict has been released earlier for 45 days and thereafter he has also enjoyed furlough in the month of November - December, 2011 only.
Under these circumstances, the discretion does not deserve to be exercised and the present application is not granted. Rule discharged.
