Learned APP, Mr.Pandya, waives service of Rule on behalf of the State.
Present applicant is already enlarged on temporary bail by order passed by this Court on 1.5.2010 recorded in Criminal Misc. Application No.5892 of 2012. Pursuant to the said order, he has to surrender on 11.5.2012.
By this application, it is prayed that in view of the marriage of his daughter which is scheduled on 13.5.2012, time to surrender before the jail authorities may be extended.
We had directed the learned APP, Mr.Pandya to verify the cause of the applicant and on verification from Patan Taluka Police Station, it is submitted that the cause mentioned in the application is genuine.
Under the circumstances, the application is allowed to the extent that time to surrender is extended till 18.5.2012 on the same terms and conditions as ordered in Criminal Misc. Application No.5892 of 2012, with the further direction that the applicant - convict shall surrender to the jail authorities on 19.5.2012. Application is allowed to the aforesaid extent. Rule is made absolute.
Learned APP, Mr.Pandya shall communicate this order to the jail authorities.
