(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail to attend the engagement ceremony of his son scheduled on 4th May, 2012.
Pursuant to the earlier order passed by this Court, learned APP, Mr.Pandya, based on the report of Patan Taluka Police Station has submitted that ground mentioned in the application is genuine.
From jail remarks, we find that whenever the applicant-convict was enlarged on temporary bail or on furlough leave, he has surrendered to the jail authorities in time.
Considering the totality of the facts, it is ordered that applicant-convict shall be enlarged on temporary bail for a period of 7 days from the date of his actual release on personal bond of Rs.5,000/- with one surety of like amount and with the further direction that he shall surrender to the jail authorities on expiry of the period granted by this Court.
Application is allowed to the aforesaid extent. Rule made absolute.
