Heard learned counsel for the petitioner and Sri Mrigraj Singh, learned counsel appearing for the respondents.
Present petition has been filed seeking direction to the respondents to consider the candidature of the petitioner in the counselling of Primary Teacher held in pursuance of the advertisement dated 30.11.2011 for which the petitioner had already applied.
The petitioner had applied for the post of Primary Teacher and is claiming benefit of his working as Shiksha Mitra. Submission is that the petitioner has completed B.Ed and T.E.T., therefore, he is entitled for such benefit. An advertisement dated 30.11.2011 was issued and in pursuance whereof the petitioner applied. As per advertisement 10% seat were reserved for Shiksha Mitra, who are still working and have the necessary educational qualification and other eligibilities and has worked for at least 3 years as such and is still working on the date of advertisement.
Admittedly, the petitioner left the working in the year 2009 for completing B.Ed as a regular candidate and was admittedly not working on the date of advertisement.
Under such circumstances, no such mandamus as is being prayed for can be granted to the petitioner.
Present petition is devoid of merits and is accordingly dismissed.
