Heard learned counsel for the parties.
The petitioner questions the notice dated 28.10.2014 issued to him under Rule 3 of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Rules, 2007 alleging violation of provisions of sub- section (2) of Section 3 of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977. The petitioner states that there is no violation as such and he has long back given a representation dated 25.4.2011 and another representation dated 1.10.2014 and without considering the said representations, the impugned notice was issued. Hence the present writ petition.
In view of the fact that this writ petition is directed only against the aforesaid notice, I am not inclined to entertain this writ petition. The petitioner can always file his reply to the said notice and raise all available pleas in support of his case. After the reply is filed by the petitioner, the respondent No.4-Tahsildar is duty bound to consider the said reply and pass appropriate orders in accordance with law. Till passing of such appropriate orders, obviously the respondent No.4 shall not take any coercive further action and further actions would depend upon the orders to be passed by the respondent No.4 after considering the petitioner’s his reply to the impugned notice. The petitioner is granted one week’s time to file his reply to the impugned notice.
With these observations, the writ petition is disposed of. Miscellaneous applications, if any, shall stand closed. No order as to costs.
