Heard learned counsel for the parties.
The petitioner’s request for issuance of pattadar pass books and title deeds was considered by the third respondent and rejected under the impugned order dated 3.4.2013. Questioning the said order, the present writ petition is filed.
It is not in dispute that the impugned order is clearly appealable. Hence I am not inclined to entertain the writ petition. However, at the same time on account of the delay, the petitioner could not be prejudiced. Therefore, liberty is granted to the petitioner to file an appeal along with an application for condonation of delay, if any, explaining the reasons, which shall be considered by the appellate authority along with the appeal on merits and appropriate orders be passed thereon expeditiously.
The writ petition is accordingly disposed of. Miscellaneous applications, if any, shall stand closed. No order as to costs.
