JUDGMENT / ORDER

Petitioners are parents one Sajeesh who owned a vehicle which got involved in a road accident occurred on 11.3.2008, leading to three OP(MV)s 529, 530 and 531 of 2008 filed before the MACT Irinjalakkuda. It is seen from the pleadings and proceedings that, on conclusion of the trial, the MACT passed Awards in all the three cases, finally leading to RR proceedings against petitioners' son. The grievance of the petitioners is that, the petitioners are in no way connected with the Award passed by the MACT or subsequent RR proceedings, in spite of which the revenue authorities are proceeding against the petitioners and hence the writ petition.
2. Heard the learned Government Pleader as well.
3. In so far as the petitioners are in no way connected with the accident and the Award passed by the MACT, it is made clear that the respondents are not justified in proceeding against the petitioners. If any such steps are mooted at the same time, it is W.P.C. No. 31457 of 2014 -2-
open for the respondents to proceed against the son of the petitioners, unless such proceedings are intercepted by any competent Court of law, in any proceeding instituted by the son of the petitioners/defaulter against the concerned OP(MV)s.
The writ petition is disposed of as above.
