This Writ Petition coming on for Preliminary Hearing in ‘B’ Group this day, the court made the following:-
ORDER The petitioner, then the third semester student of Engineering is grieving against the endorsement dated 03.09.2018 issued by the respondent-college at Annexure-J, which reads as under:

By the said endorsement, the petitioner is denying the facility of transfer from the present college to the other college on the ground that such a transfer if acceded to, will result into the minimum students strength prescribed by Law being diminished. The permitted strength of the Institution in which the petitioner has been prosecuting the studies being 60 and the actual intake being 40, if the petitioner is permitted to migrate from the college in question to some other college, there will be a shortfall by one and therefore, the strength would eventually go below, the prescribed 75% as mentioned in the All India Council For Technical Education, New Delhi Guidelines dated 30.08.2001 at Annexure-R2 to the Statement of Objections filed by the respondent-University as contended by its learned panel counsel Sri. Santosh S. Nagarale.

However, learned Panel Counsel for the University submits that the petitioner is now studying the fourth Semester of Engineering course and therefore, if he gives a representation furnishing all the material particulars as are required for consideration of request for migration from one college to another, the same would be considered in accordance with the aforesaid guidelines, forthwith at fifth semester level.
4. In view of the above, this Writ Petition succeeds in part; a Writ of Mandamus issues to the respondent- University to consider petitioner’s representation after hearing is provided both the petitioner and concerned Colleges in accordance with the aforesaid Guidelines, and to inform the petitioner the result of such consideration without brooking delay.
