Heard Sri Chhavi Kant Vashistha, learned counsel for the applicant, Sri Takeshwar Yadav learned AGA for the State and perused the material placed on record.
This bail application has been moved seeking bail in Case Crime No.1031 of 2017 under sections 21/22 N.D.P.S. Act, Police Station Kotwali, District Mathura, during the pendency of trial.
The contention of the learned counsel for the applicant is that the accused has been falsely implicated. 300 grams Alprazolam a narcotic substance is shown to have been recovered from him which is more than commercial quantity.The applicant is not involved in any other criminal case. The applicant is absolutely innocent and is languishing in jail since 08.10.2017. In case the applicant is released on bail he will not misuse the liberty of bail.
Per contra learned A.G.A.vehemently opposed the bail prayer of the applicant and it has been argued that the same has been found as Alprazolam after being tested.
In the light of the aforesaid arguments, looking to the fact of the case, it is not found to be a fit case for bail.
The bail application is accordingly rejected.
