Heard learned counsel for the petitioner and perused the record.
The present petition has been filed for direction upon the court of Civil Judge (Jr. Div.), Robertsganj, Sonbhadra to decide Original Suit No.29 of 2012 (Dannu Vs. Kailash and others) within stipulated period.
From the order sheet of the court below it appears that the court is lying vacant and therefore the matter had to be adjourned.
Under the circumstances, this Court finds no good reason to issue any specific direction. However, in case the court where the proceedings are pending is lying vacant since long, it shall be open to the petitioner to apply to the District Judge concern for transfer of the proceeding to another court of competent jurisdiction. In case the court where the proceedings are pending is available, it shall be open to the petitioner to move expedite application before the court concerned.
With the aforesaid liberty, the petition is disposed off. Order Date :- 27.4.2018.
