Heard Mohammad Arshad Khan, learned counsel for the applicant and Sri Gyan Prakash Singh, learned State Law Officer, appearing for the State Opposite party.
The present application under section 482 Cr.P.C. has been filed seeking to quash the cognizance order dated 14.02.2020 passed by the Learned Special Judge, S.C./S.T. Act/ Additional Sessions Judge, Rampur and also the entire further proceedings of charge sheet dated 24.11.2019 submitted by the Investigating officer of the case in Case Crime No. 938 of 2018 under Section 307, 323, 504 I.P. and 3(1)(da), 3(1)(dha) S.C./S.T. Act, Police Station-Civil Lines, District Rampur.
Counsel for the applicant after making submissions to some extent fairly submits that the necessary ingredients for invocation of powers under Section 482 Cr.P.C. are not made out in the facts of the present case and accordingly, he does not wish to press the prayers made in the application. The reliefs sought are therefore, not entertained.
Counsel for the applicant states that the applicant would submit to the jurisdiction of the court below and seek recall of the non- bailable warrant which has been issued against him.
In case any such application is moved by the applicant, the court below would be expected to pass appropriate order thereon in accordance with the settled principles of law.
