Heard learned counsel for the petitioners as well as learned A.G.A for the State.
This petition has been filed seeking writ, order or direction in the nature of certiorari for quashing the impugned first information report registered as FIR/Case Crime No.0661 of 2016, under Sections 147, 148, 149, 307, 427 IPC, Police Station Kotwali Nagar, District Sultanpur, as contained in Annexure No.1 to the writ petition.
After arguing the matter as some length, learned counsel for the petitioners states that he may be permitted to apply for anticipatory bail before the Court concerned and till then no coercive action may be taken against the petitioners.
Learned A.G.A. has no objection to the above prayer of learned counsel for the petitioners.
Considering the submissions made by learned counsel for the parties and going through the record, the writ petition is disposed of with the observation that the petitioners may avail the remedy of anticipatory bail by moving an appropriate application under Section 438 Cr.P.C. before the Court concerned within three week's from today and for a period of three week's, no coercive action shall be taken against the petitioners in the aforesaid case.
