Order:
This Appeal is filed by the unsuccessful plaintiff in OS.No.5 of 2013 against judgment and decree, dated 25.04.2013, passed by the learned Additional District Judge, Vikarabad, Ranga Reddy District.
Learned Counsel for both parties have requested the Court to allow this Appeal in terms of Memorandum of Understanding, dated 27-06-2014, entered between the parties. The Memorandum of Understanding, signed by the appellant and both the respondents, has been filed along with Joint Memo, dated 08-07-2014.
All the parties are present at the hearing. When this Court has enquired, all of them submitted that they are aware of the contents of the Memorandum of Understanding and that the same was entered out of their free will and consent.
A perusal of Memorandum of Understanding, dated 27.06.2014, inter alia shows that the respondents have declared that they have no right, title or interest over the suit schedule property and that the appellant shall be the pattadar and possessor of the said property.
In view of the same, Memorandum of Understanding dated 27.06.2014, is taken on record and the Appeal is allowed in terms of the said Memorandum of Understanding.
Registry shall draft the decree in AS.No.571 of 2013 in terms of the said Memorandum of Understanding.
As a sequel, interim order, dated 13-09-2013, is vacated and ASMP.Nos.1594 of 2013 and 1264 of 2014 are disposed of.
