Heard Shri R.P. Pandey holding brief of Shri Moti Lal Chauhan, learned counsel for the petitioner and the learned standing counsel for the respondents no. 1 to 5.
The petitioner is seeking protection in view of the threat perception from the respondents no. 6 to 9. The respondent no. 7 is stated to be the wife of the petitioner. It is stated that the petitioner has made a complaint before the S.S.P. Gautam Budh Nagar on 6.5.2019 with receiving of the same date, copy of which has been filed from pages 51 to 53 of the writ petition. The personal allegations have been made against the respondents no. 6,8,9 and 10. It is stated that a criminal case under section 307 IPC is also pending against the petitioner.
No useful purpose would be served in keeping this writ petition pending.
This writ petition is therefore disposed of with a direction to the respondent no. 5-Senior Superintendent of Police, Gautam Budh Nagar to consider and decide the petitioner's complaint dated 6.5.2019, at pages 51 to 53 of the writ petition in accordance with law and pass appropriate orders within one month from the date of receipt of a certified copy of this order.
It is made clear that the court has not adjudicated the claim of the petitioner on merit.
