By impugned order dated 9.1.2018, the District Inspector of Schools has proceeded to recognise election of the Committee of Management of Nehru Inter College, Korokuiyan, Shahjahanpur held on 7.1.2018 under the supervision of observer appointed by the office of District Inspector of Schools, subject to decision in Suit No.348 of 2013.
The petitioner, who claims himself to be a member of the General Body of the Society, alleges that the election notification was not published in newspaper having wide circulation nor proper notice was given to the members before election was held.
The petitioner has not set up any parallel election. In case the petitioner, who is a single member, is disputing the election of the Committee of Management held on 7.1.2018, it is open to him to raise the dispute before the Regional Level Committee. However, this Court is not inclined to entertain the challenge at the instance of the petitioner, as the dispute involves determination of questions of facts.
Accordingly, the writ petition is disposed of with liberty to the petitioner to approach the second respondent with his grievance.
