Heard learned Counsel for the petitioner and Ms. Subhra Singh, learned Standing Counsel for the State- respondents.
In case the respondent Nos.7 and 8 have encroached upon chak marg (public rasta) as alleged by the petitioner, then the appropriate remedy is to either initiate proceedings under Section 133 Cr.P.C. or to initiate proceedings under Section 67 of the U.P. Revenue Code, 2006. Moving of miscellaneous representations is not the proper remedy.
Leaving it open the aforesaid two remedies to the petitioner, we dismiss this petition.
