This Public Interest Litigation has been instituted raising the grievance that the Committee of Management of College has collected the money from each student of the institution which is illegal and contrary to the provisions of the U.P. Intermediate Education Act and Regulations framed therein.
Learned Standing Counsel has received the instruction from the District Inspector of Schools, which is taken on record.
From the perusal of the instruction, it appears that prima facie the grievance raised by the petitioner is correct. Ordinarily this Court does not interfere in such matters under the Public Interest Litigation but having regard to the admitted fact that illegal collection is being made from the students, we are of the view that the ends of justice requires that a direction be issued to the Director of Education(Madhyamik), Lucknow to look into the matter and take action against the erring persons after conducting an enquiry. The Director of Education(Madhyamik), Lucknow shall furnish an opportunity to the Manager of the institution and the Principal of the institution. The said action be taken expeditiously preferably within three months from the date of communication of this order.
The Director of Education(Madhyamik), Lucknow shall send a compliance report to the Registrar General of this Court, who shall place the compliance report on the record of this case.
The office is directed to furnish a copy of this order to Sri Mohit Kumar Shukla, learned brief holder for communication and compliance of this order.
The Public Interest Litigation is disposed of.
