Heard learned counsel for the petitioner. Learned Standing Counsel accepted notice on behalf of respondent Nos.1, 2 & 3.
In view of the order proposed to be passed, notices need not go to the respondent Nos.4 to 9.
After some arguments, a prayer has been made by learned counsel for the petitioner to issue a mandamus directing the Settlement Officer of Consolidation, Mau/respondent No.2 to decide the application of the petitioner dated 11.9.2019 in which prayer has been made to transfer his case from the present consolidation officer to some other consolidation officer.
From perusal of the record, it appears that the application dated 11.9.2019 submitted by the petitioner, copy of which is appended as Annexure No.9 to the writ petition, a report was called for from the Consolidation Officer. It is argued that in spite of the fact that considerable time has already been lapsed but till date no decision has been taken on the application.
Learned Standing Counsel has no objection to the prayer made by petitioner.
Heard learned counsel for the parties present. With the consent of learned counsel for the parties present, the present writ petition is disposed of at the admission stage itself.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the respondent No.2/Settlement Officer of Consolidation, Mau to consider and decide the aforesaid application in accordance with law expeditiously and preferably within a period of one month from the date of production of certified copy of this order but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties.
