The contention of learned counsel for the petitioners is that over Plot No.1256, village Bharnakhurd, Tehsil Chhata, District Mathura, the petitioners had built their houses since a very long time and that instead of regularising their possession under section 123 of the U.P. Zamindari Abolition and Land Reforms Act, 1950 (hereinafter referred to as the 'Act'), the Revenue Authorities were intending to allot those very plots to other villagers under section 122-C of the Act.
If this is the case of the petitioners, then they may object to the allotment and the Sub-Divisional Officer shall, after taking evidence, decide whether the petitioners have their constructions from before 13.5.2007. If the Sub-Divisional Officer concludes that the houses had been built before the cut-off date of 13.5.2007, as has been given under section 67-A of the U.P. Revenue Code, 2006, no further allotment shall take place.
The writ petition is, accordingly, disposed of.
