JUDGMENT / ORDER

------------------- Petitioners have approached this Court seeking for a direction to the 4th respondent to accept the Land Tax with reference to the property having an extent of 0.1860 Hectare in Block No. 92 in Re-Survey No.369/10 obtained as partition deed No. 2103/1959 of Vandoor Sub Registry in the name of the petitioners' father. Petitioners' father died, when the tax was offered, the same was not received by the Village Officer. Learned Government Pleader on instructions would submit that as per village records the property originally stood in the name of SNDP Yogam and they were conducting an Aiyyappa Swami Madom. Later, on the request of the petitioners' father, his name was also included in the Thandapper Register. However, the SNDP Yogam has filed an appeal against the inclusion of petitioners' father's name in the Thandapper Register, which appeal is pending before the Sub Collector, Perinthalmanna.
2. Having regard to the aforesaid submission, I do not think that this Court will be justified in issuing the direction as matter stands now. Petitioners' right if any, to pay the tax W.P.C.No. 6329 OF 2014 2 or to get the property mutated in their name will arise only after the disposal of the said appeal.
In the result, this writ petition is disposed of as under:
The petitioners shall be at liberty to implead in the appeal filed by the Aiyyappa Swami Madom, which is pending before the Revenue Divisional Officer and take appropriate proceedings in accordance with law. All endeavour shall be made by the said authority to dispose of the same as expeditiously as possible.
