Pursuant to the order dated 12.1.2018, after conducting proper enquiry as per the Circulars issued by this Court, a report dated 19.2.2018 has been sent by the Chief Judicial Magistrate, Pilibhit mentioning therein that the accused / appellant Dafedar has expired about 14 years ago. Since the sole appellant Dafedar has expired, the appeal has lost its sanctity.
Accordingly, the appeal on behalf of the sole appellant Dafedar stands abated. The record of the appeal be consigned.
A copy of this order with full particulars be sent through FAX to the Chief Judicial Magistrate concerned within a week for communication and action.
