JUDGMENT / ORDER

1.0 Present application is filed by the under trial prisoner, who is in jail in connection with C.R. I-374/2011, registered with the Amraiwadi Police Station for the offenses punishable under Sections 302, 120B and 34 of the Indian Penal Code and Section 135(1) of the Bombay Police Act. Besides, there is an application filed by the Police Inspector, Crime Branch, Ahmedabad City to the Metropolitan Magistrate Court No. 11 to add further sections of Indian Penal Code viz. 324, 143, 144, 147, 148 and 149, which is kept with the F.I.R.
2.0 The application is filed seeking Temporary Bail for 20 days so as to arrange for the operation of his wife. Medical papers, in support of the application are produced.
3.0 Rule.
Learned Additional Public Prosecutor Mr. Patel waives service of process of Rule.
4.0 Taking into consideration the contents of the application, the application is allowed. The under trial prisoner is ordered to be released on Temporary Bail for a period of 20 days from the date of his release, on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand only) with one surety of the like amount to the satisfaction of the jail authorities.
4.1 In addition to above, the under trial prisoner is directed not to leave the limits of Ahmedabad city.
4.2 The under trial prisoner shall mark his presence at the nearest Police Station on every alternate day between 9:00 a.m. and 2:00 p.m. 4.3 The applicant - convict shall surrender to the jail authorities on expiry of the Temporary Bail period.
4.4 Rule is made absolute to the aforesaid extent.
