Heard learned counsel for the applicants and learned A.G.A for the State.
The instant anticipatory bail application has been filed on behalf of the applicants, Dablu Singh @ Dipendra Singh and Arvind Singh, with a prayer to release them on bail in Case Crime No. 5 of 2021, under Sections- 147, 148, 149, 386, 504, 506 I.P.C. & Section 7 of Criminal Law Amendment Act, Police Station- Lalauli, District- Fatehpur, during pendency of trial.
There is allegation against the applicants that they were involved in extortion of minor minerals. Learned counsel for the applicants has submitted that the applicants have been falsely implicated in this case.
On the basis of allegations made against the applicants, this Court finds that unlimited anticipatory bail cannot be granted in view of judgement passed in the case of Sushila Aggarwal and Ors. Vs. State (NCT of Delhi) and Ors., MANU/SC/0100/2020.
Learned counsel for the applicants prays that in view of the ongoing second wave of novel coronavirus, he may be granted sometime to obtain bail from the court below.
On the request of learned counsel for the applicants, it is directed that the applicants will appear and surrender before the court below within 45 days from today and apply for bail.
Till then, no coercive action shall be taken against the applicants.
However, in case, the applicants does not appear before the court below within the aforesaid period, coercive action shall be taken against them.
It is made clear that the applicants will not be granted any further time by this court for surrendering before the court below as directed above.
With the aforesaid directions, this application is finally disposed of.
