Heard learned counsel for the applicants and learned A.G.A. This application has been filed with a prayer to quash the proceedings of complaint case No. 344 of 2009 under sections 295, 327, 379, 323, 504, 506, 147, 149, 406 I.P.C., P.S.Etmadpur District Agra pending in the court of learned 13th Addl. Chief Judicial Magistrate, Agra. From the perusal of the record it appears that after considering the complaint and statements recorded under sections 200 and 202 Cr.P.C.,which disclose the commission of the offence , the learned Magistrate has taken cognizance and summoned the applicants vide order dated 19.3.2010. There is no illegality or irregularity in the impugned order dated 19.3.2010, there is no illegality in prosecution of the applicants, therefore, the prayer for quashing the proceedings of above mentioned case is refused.
However,considering the fact it is directed that in case applicants appear before the court concerned within 30 days from today and apply for bail, the same shall be heard and disposed of on the same day by the courts below.
