Mr.Ankit Shah, learned advocate for the petitioner states, upon instructions, that the petitioner is desirous of giving up the challenge to the impugned order to the extent that it cancels the allotment of land in favour of the petitioner. He, however, states that the respondent-Surat Urban Development Authority may return the amount of Rs.68,28,003/- deposited by the petitioner in the year 2006, that had been forfeited by the impugned order dated 17.07.2009. Mr.H.S.Munshaw, learned advocate for the Surat Urban Development Authority may take fresh instructions.
