Learned advocate for the petitioner relies on the order passed in a departmental inquiry for the charges similar to that of the subject matter of this petition and the complaint impugned, where for administrative lapses the petitioner was censured. Further, with regard to payment it was noticed that after completion of 70% of the work only, payment was ordered.

Learned APP waives service of rule for respondent - State of Gujarat.

Ad-interim relief in terms of para 17[D] qua the petitioner only.
