JUDGMENT / ORDER

(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) This appeal is ADMITTED on the following substantial questions of law:
[1]. Whether the Tribunal below committed substantial error of law in deleting the addition of Rs.12,65,550/- on account of mobilization advance received from GCPE, a client of the assessee, by totally overlooking the fact that the said amount, under the agreement, was not a refundable one.

Whether the Tribunal below committed substantial error of law in deleting the addition of Rs.90,000/- on account of club membership fee of one of the partners in the absence of any evidence indicating that such membership is beneficial for the advancement of business of the assessee.

Whether the Tribunal below committed substantial error of law in confirming the order passed by the CIT [Appeals] without assigning any reason of its own for formation of the findings, in violation of the principles laid down by the Supreme Court in the case of MANGALORE GANESH BEEDI WORDS vs. COMMISSIONER OF INCOME TAX AND ANOTHER reported in [2005] 273 ITR 56 [SC].
