ORDER:
This writ petition is filed for the following substantive relief: “…to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the proceedings of the 3rd respondent passed in D.Dis.D1CS/5561/2-14 dated 28.10.2014 wherein cancelling the F.P. shop dealership of the petitioner shop No.37 of Kandukur Village, Anantapur Mandal, Anantapur District on flimsy grounds, as illegal, arbitrary and contrary to G.O.Ms.No.12 Consumer Affairs Food and Civil Supplies (CS) Department dated 27-2-2009 and also being violative of Articles 14, 16 and 21 of the Constitution of India and seeking consequential direction to continue the petitioner as fair price shop dealer of Shop No.37 of Kandukuru Village, Anantapur Mandal, Anantapur District.”
In obedience to the notice issued by this Court, the incumbent of respondent No.3 is personally present. He has stated that on realizing his mistake in passing the impugned order, he has restored the petitioner’s fair price shop authorization vide proceedings in Rc.D1CS/8843/2014 dated 17.11.2014. He has also submitted to the Court that further action against the petitioner on the charges mentioned in the impugned order is deemed to have been dropped and that he will not proceed with the further enquiry on the said charges.
The above submissions of respondent No.3 are placed on record and the writ petition is disposed of in view of the corrective steps taken by him.
As a sequel to the disposal of the writ petition, W.P.M.P.No.42868 of 2014 shall stand disposed of as infructuous.
