JUDGMENT / ORDER

ORDER:
This Contempt Case is filed alleging willful disobedience of order, dated 17.12.2013, in Writ Petition No.35908 of 2013.
At the hearing, there is no representation for the petitioner.
I have heard learned Government Pleader for Home (Andhra Pradesh) and perused the record.
The petitioner filed the above-noted Writ Petition with the grievance that the respondent is not completing the investigation and filing a charge sheet/final report though a crime is registered as far back as 27.12.2012.
By order, dated 17.12.2013, this Court disposed of the said Writ Petition placing on record the instructions of the learned Assistant Government Pleader for Home that investigation is at an advanced stage and that an appropriate report/charge sheet will be filed before the jurisdictional Magistrate under Section 173(2) of the Code of Criminal Procedure, 1973. Alleging that no charge sheet/final report was filed by the respondent, the petitioner filed this Contempt Case.
The respondent filed a counter-affidavit wherein he has, inter alia, stated that he has filed a final report on 18.09.2014 referring the case as “Civil in nature” in the Court of the learned Additional Judicial First Class Magistrate, Addanki, Prakasam District. He has explained the reasons for delay in complying with the order passed by this Court in paragraph Nos.16 to 18 and tendered unconditional apology for the abnormal delay caused in complying with the order of this Court. As the respondent has complied with the order of this Court and furnished satisfactory explanation for the delay, the Contempt Case is closed and the respondent is discharged from the contempt proceedings.
