Heard learned counsel for the petitioners and learned AGA for the State.
The petitioners in the present writ petition are seeking quashing of the FIR dated 04.12.2019 registered as Case Crime no. 1153 of 2019 under Sections 409, 420 and 120-B IPC, Police Station Chakeri, District Kanpur Nagar with a further prayer not to arrest the petitioners in pursuance of the said FIR.
It is noticed that the three petitioners are Printing Firms through their proprietors. Criminal Proceedings can be initiated against an individual who can be taken into custody and not a firm therefore, this writ petition is not maintainable against the petitioners in the manner in which they are arrayed in the writ petition.
Learned counsel for the petitioners prays that he may be permitted to withdraw this writ petition with liberty to file fresh writ petition.
The writ petition is dismissed as withdrawn with aforesaid liberty.
The certified copy of the FIR may be returned to the learned counsel for the petitioner.
