ORDER:
This writ petition is filed for a Mandamus to declare the action of respondent Nos.1 and 2 in allowing respondent No.3 to proceed with construction without obtaining building permission as illegal and arbitrary.
On behalf of respondent Nos.1 and 2, General Manager (Law) of the Andhra Pradesh Industrial Infrastructure Corporation Limited filed a counter affidavit, wherein it is inter alia admitted that respondent No.3 who is the allottee of plot No.6 has commenced construction by raising columns of 4 feet from ground level without approval of building plan, that on 15.09.2014, a notice was served to respondent No.3 informing him to stop the work with immediate effect and that in response to the said notice, respondent No.3 has stopped the work and submitted building plan on 20.09.2014 along with the required documents and requisite fee for approval.
In the light of the above stand taken on behalf of respondent Nos.1 and 2, no further adjudication of the writ petition is necessary. Respondent Nos.1 and 2 are however directed to ensure that respondent No.3 does not proceed with the further construction of the building without the approval of the building plan.
Subject to the above direction, the writ petition is disposed of.
As a sequel to disposal of the writ petition, W.P.M.P.No.35367 of 2014 shall stand disposed of as infructuous.
