Pointing out certain lapses in proceeding further with the investigation and filing final report by the respondents, who miserably failed to complete the investigation within the reasonable time, the petitioner is before this Court for transferring the case in Cr.No.2 of 2016 to some other investigating agency.
2. The learned Additional Public Prosecutor, on instructions, today, produced a letter of the Superintendent of Police, Villupuram dated 21.10.2016 in C.No.K3/43740/2016, wherein it is stated as follows:
“ On perusal of the C.D file a case in DCB Cr.No.2/2016 i/s 417, 420, 406 IPC, it is learnt that, the investigation of the case is not in a proper line. The Investigating Officer has not obtained confession statement from the arrested accused Manjunath also failed to recover cheating amount. The case is under investigation stage without any progress for the past 9 months. Hence Tr.T. Veemaraj, Dy. Supdt. Of Police, DCB-II, Villupuram is directed to take up further investigation in the above case and lay final report at the earliest.
2) Tr. Sundaresan, Inspector of Police, DCB, Villupuram is instructed to hand over the C.D file of above case and connected records to Tr.T. Veemaraj, Dy.Supdt. Of Police, DCB-II Villupuram, immediately.

Since the prayer of the petitioner is met with and now the matter has been transferred to Deputy Superintendent of Police, DCB-II, Villlupuram, who has taken charge recently, the Deputy Superintendent of Police, DCB-II, Villlupuram is directed to conduct proper investigation and complete the enquiry as provided under the law. With the above direction, the criminal original petition is disposed of.
