THE HON’BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION NO.28068 OF 2014 ORDER:
Heard Sri P.Venkateswer Rao, learned counsel appearing for the petitioner and Sri N.Vasudeva Reddy, learned standing counsel for APSRTC., appearing for the respondents.
This writ petitioner is filed seeking a writ of mandamus, declaring the action of the respondents in not allowing 12 years Special Grade/Station Increment to the petitioners with effect from their completion of 12 years of service rendered in their respective posts irrespective of regions of APSRTC., as bad, arbitrary, illegal, unjust, discriminatory and consequently direct the respondents to effect 12 years Special Grade/Stagnation increments to the petitioners with proper fixation by counting entire service rendered in the present post irrespective of the regions.
The petitioners are the employees of the first respondent corporation. They submit that all of them have rendered 12 years of continuous service and they are entitled for Special Grade/Stagnation increment. When the respondent corporation refused to grant 12 years Special Grade/Station increments to some of the employees, they approached this Court by filing W.P.No.5726 of 2000 and the learned Single Judge of this Court disposed of the said writ petition, holding that on completion of 12 years of continuous service, the petitioners are entitled for Special Grade Increment notwithstanding the fact that they worked in different regions. The said order was confirmed in W.A.No.1301 of 2000 by order dated 29-10-2002 and it has become final.
The issue involved in the present writ petition is squarely covered by the aforesaid order of the learned Single Judge, which was confirmed in the writ appeal.
In view of the above circumstances, the respondents are directed to sanction 12 years Special Grade/Stagnation increment to the petitioners if they completed 12 years of continuous service in the respondent corporation irrespective of regions, in terms of the order in W.P.No.5726 of 2000 dated 23-8-2000.
The writ petition is disposed of accordingly. There shall be no order as to costs. The Miscellaneous Petitions pending if any shall stand closed.
