THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 14876 of 2014 ORDER: (Per the Hon’ble The Chief Justice Sri Kalyan Jyoti Sengupta) We are not inclined to entertain the writ petition against the impugned order of punishment, as the petitioner was heard with the issuance of notice. Hence, the question of violation of principles of natural justice does not arise.
The writ petition is accordingly dismissed. However, it would be open for the petitioner to file departmental appeal with a prayer for condonation of delay, if there is any delay, and the appellate authority shall condone the delay and decide the matter on merit in accordance with law. The petitioner shall prefer such appeal within a period of 30 days from the date of receipt of a copy of this order. No order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
