D. Kamal Kumar vs State Rep By

Madras High Court|16 November, 2017

JUDGMENT / ORDER

This petition has been filed for a direction to the learned Principal Sessions Judge, Chennai to modify the condition imposed on the petitioners in Crl.M.P.No.16820 of 2017 dated 07.11.2017.
2.On a perusal of the order dated 07.11.2017, it is seen that the petitioners have granted anticipatory bail, on condition to stay at vellore and report before the learned Judicial Magistrate No.I, Vellore, daily at 10.30 a.m. for one month. The fact remains that the petitioners are residing at Chennai.
3.Hence, this Court is of the view that there is no justification on the onerous condition of making the petitioners to be stayed at Vellore and to report, before the learned Judicial Magistrate No.I, Vellore.
4.Hence, the condition imposed in paragraph 6(iii) of the order dated 07.11.2017 in Crl.M.P.No.16820 of 2017 on the file of learned Principal Sessions Judge, Chennai is modified to the effect that the petitioners shall report before the respondent police, as and when required. It is made clear that the other conditions and observations in the order dated 07.11.2017 made in Crl.M.P.No. 16820 of 2017 on the file of learned Sessions Judge, Chennai shall remain intact.
4.With the above modification, the Criminal Original Petition stands allowed.
