WRIT PETITION No.12619 of 2011 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of the respondents in proposing to retire the petitioner from service on attaining the age of 58years instead of 60 years as arbitrary and against the Provisions of Act 23 of 1984 which has been made applicable to the Tirumala Tirupathi Devasthanam by virtue ofG.O.Ms.No.1060 Revenue (Endts.III) Department dated 24.01.1989 duly extending the benefit of judgment rendered by this Court in W.A.No.230 of 2003 and batch, dated 27.07.2010 and consequently to direct the respondents to continue the petitioner in service till such time he attains the age of 60 years which is the normal age of retirement for workman of the T.T.D. Printing Press with all consequential benefits.
It is agreed by both the learned counsel appearing for the parties that the issue raised in this writ petition is squarely covered by order dated 12.08.2013 passed by this Court in W.P.No.17518 of 2010.
In view of the above, this writ petition is disposed of in terms of the said order with the direction that the observations made therein shall be read as part of this order. The respondents are directed to determine the age, structure and retirement benefits treating that the petitioner retired from service on 30.06.2013 and shall settle the benefits within four months from the date of receipt of a copy of this order. There shall be no order as to costs.
Pending miscellaneous petitions, if any, shall stand closed in consequence.
