JUDGMENT / ORDER

Respondents Habeas Corpus Petition filed under Article 226 of the Constitution of India to issue a writ of Habeas Corpus or any other order or direction more specifically a writ and direct the respondents to produce the petitioner's wife Anbu Chithra and son Deepak before this Court.

NAGAMUTHU,J.,) The petitioner is the husband of one Mrs.Anbu Chitra and father of minor Deepak. According to him, the marriage took place in the year 2000. Thereafter, they were living together. There was a frequent quarrel between the petitioner and his wife. In the year 2015, his wife/the detenue left the matrimonial home along with her son. In this regard, the petitioner made a complaint to the respondent Police. On the basis of the same, a case in Crime No.782 of 2016 has been registered. Even after registering the complaint, no efforts have been taken by the respondent Police, to trace out the detenus. Hence, the petitioner is before this Court with this Habeas Corpus Petition.
2. The learned Additional Public Prosecutor appearing for the State would submit that there was a quarrel between the petitioner and the detenue and hence, she left the matrimonial home. Further, due to the domestic quarrels, the detenue is in the habit of frequently going to her mother's house. This Court convinced that there is no illegal detention and it seems that the detenue left the matrimonial home on her own accord.
3. In the result, the Habeas Corpus Petition is closed however, with a direction to the respondent Police to continue the investigation expeditiously.
