JUDGMENT / ORDER

THE HON’BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION No.32003 of 2014
ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus, declaring the action of the 3rd respondent in issuing the impugned proceedings dated 19.09.2014 as illegal, arbitrary and to set aside the same and consequently direct the 3rd respondent to forthwith reinstate the petitioner into service as Field Assistant.
The petitioner who is Field Assistant was suspended on certain allegations and an enquiry was held against her and thereafter, on the ground that the charges leveled against her have been proved, she was removed from service. The petitioner preferred appeal to the 2nd respondent and the same is pending.
The learned counsel appearing for the petitioner submits that the petitioner is not responsible for handling the funds and she was unnecessarily terminated from service.
On the other hand, the learned special standing counsel appearing for the respondents would submit that the charges have been duly proved against the petitioner during the course of enquiry held against her.
Having regard to the submissions made by both the learned counsel, the 2nd respondent is directed to hear and dispose of the appeal of the petitioner pending with him, in accordance with law, within a period of 2 (two) months from the date of receipt of a copy of this order.
The Writ Petition is accordingly disposed of. No order as to costs.
Pending miscellaneous petitions, if any, shall stand closed in consequence.
