JUDGMENT / ORDER

When the matter is taken up for hearing, the learned counsel for the petitioner submitted that the surcharge award has been passed against the petitioner as well as the President of the Society and other employees of the Society. Challenging the said surcharge order, the petitioner has filed an appeal. The aforesaid appeal was dismissed and he filed the present writ petition before this Court.
2. The learned counsel for the petitioner would submit that pending the writ petition, the then President of the Society, who is also a party to the surcharge award has paid surcharge amount to the petitioner Society. The aforesaid contention was not denied by the learned counsel for the respondents. The learned counsel for the respondents seeks liberty if any arrears of amounts to be paid by them under the surcharge award and the same shall be recovered from the petitioner and other employees jointly and severally.
3. In view of the submission made by the learned counsel for the parties, no further adjudication is required in the writ petition, this Writ Petition is disposed of with liberty. No costs. Consequently, connected Miscellaneous Petition is closed.
