For Petitioner : Mr.M.Sathish Kumar For respondent : Mr.C.Emalias, Addl. Public Prosecutor ORDER The present criminal original petition has been filed seeking a direction to the respondent to file a final report in Crime No.731 of 2016 within a stipulated period.
2. It is the case of the petitioner that as against one Rajasekar and Sudha, she lodged a complaint with the respondent police on 25.4.2016. Since the respondent refused to receive the complaint, she preferred a petition before the learned XV Metropolitan Magistrate, George Town, Chennai, under Section 156(3) Crl.P.C. and the learned Magistrate directed the respondent to register a case based on the complaint given by the petitioner. Thereafter, the respondent registered a case in Crime No.731 of 2016 for the offence punishable under Sections 270, 427, 294(b) and 506(ii) I.P.C. on 13.7.2016. Even after registration of the said case, the respondent has not taken any action to investigate the case and file final report. Hence, the present petition.
3. I have heard the learned Additional Public Prosecutor.
4. Considering the facts and circumstances of the case, this Court directs the respondent to investigate the case in Crime No.731 of 2016 pending on his file and file a final report, as expeditiously as possible, preferably, within a period of six weeks from the date of receipt of a copy of this order. The Criminal Original Petition is ordered accordingly.
