It is alleged in the writ petition that the alleged detenu was illegally detained by the Police, whereas in the counter affidavit it has been specifically stated that the alleged detenu is wanted in connection with a criminal case pending against him, and he was absconding for some time and the allegation of factual detention is absolutely incorrect. He could not be traced earlier but now he is traceable and the Police will arrest him in connection with the criminal case.
We therefore close the writ petition directing the Investigating Officer or the Police Officer concerned to arrest the alleged detenu forthwith and immediately thereafter produce him before the concerned learned Magistrate. There will be no order as to costs.
