JUDGMENT / ORDER

Petitioner has approached this Court complaining about the inaction on the part of the 1st respondent in taking action pursuant Ext.P8. He is a person, who has got allotment of certain item of land under the category of ex-servicemen. According to him, there had been lot of encroachers in the aforesaid land and he had been requesting the authorities to provide certain alternate land, but no action had been taken in the matter. 2. The learned Government Pleader, on instructions, would submit that assignment was made as early as in 1970, and despite issuing some letters to the authorities no action had been taken and therefore the representation was rejected on the ground of delay and laches. That apart, if there are encroachers, it is for the petitioner to take necessary action to remove the encroachment and for that reason he cannot claim alternate land.
3. Having regard to the aforesaid factual situation, admittedly this is a case which ought to have been rejected at the threshold for the delay in approaching this Court. But in so far the petitioner is an ex-serviceman and since the requesrt is W.P.(C) No.26177 of 2012 -: 2 :-
for alternate land, I am of the view that the 1st respondent should consider Ext.P8, make enquiries regarding the same and pass appropriate orders within six months from the date of receipt of a copy of this judgment.
The writ petition is disposed of as above Sd/- A.M. Shaffique, Judge.
