The writ petition was filed in the year 2008 challenging the recovery proceedings initiated against the petitioner for recovery of arrears in a loan account. The recovery was initiated for a total amount of Rs.38,500/- which is due as indicated in Ext.P2. This Court had directed payment of Rs.1000/- per month on or before 20th of every month. If the instalments were complied with, the petitioner would have satisfied the loan amount; if not, no further equity can be granted. The respondent Bank would be entitled to recover any amounts due in the loan account which is the subject matter of the above writ petition. The writ petition would stand dismissed, WP(C).28371/08 2 leaving the parties to suffer their respective costs.
