C.T.Narasimmalu vs The Collector

Madras High Court|07 November, 2017

JUDGMENT / ORDER

The learned counsel for the writ petitioner made a submission that the order of transfer issued by the first respondent in proceeding dated 31.10.2013, is under challenge in this writ petition. Further, the learned counsel for the petitioner fairly submits that the writ petitioner joined in the transferred place and now working. Transfer being an incidental to service and more so a condition of service. Now after a lapse of 4 years from the date of the issuance of the order of transfer by the respondent, this Court is not inclined to consider the grounds raised on merits. Even as per the policy decision, the Government employees are bound to work in a particular place for a minimum period of 3 years. Now that more than 3 years have lapsed from the date of filing of the writ petition, no further adjudication on the grounds needs to be undertaken.
2.Accordingly, the writ petition stands dismissed, However, there shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
