THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R Learned Additional Government Advocate takes notice for respondents.
2. When this matter had come up before this Court on 05.02.2019, learned counsel for the petitioner submitted that he had received instruction from the petitioner to withdraw this writ petition and since the same was not communicated to him in writing, he had sought time till today to obtain written communication from the petitioner.
3. Today also, learned counsel for the petitioner reiterates the same submission as made on 05.02.2019.
4. In that view of the matter, this Court find that there is no point in keeping this Writ Petition pending before this Court endlessly. Therefore, the present Writ Petition is dismissed on the premise that the petitioner is not interested in pursuing the same. However, in the event if the petitioner wants this petition to be revived, it is open for them to make appropriate application and seek revival of the same and on such application, the petition shall be considered on merits.
5. With such observations, this Writ Petition is dismissed.
6. Learned Additional Government Advocate is permitted to file memo of appearance within two weeks from today.
