RAVI KUMAR CRIMINAL PETITION No. 9387 OF 2012 CRIMINAL PETITION No. 2099 OF 2013 CRIMINAL PETITION NO. 10622 OF 2013 COMMON ORDER :
These Criminal Petitions are filed to quash proceedings in CC.No. 102 of 2011 on the file of XIV Metropolitan Magistrate, L.B. Nagar, Cyberabad, Ranga Reddy district for alleged offence under section 498-A, 506 IPC and section 3 and 4 of Dowry Prohibition Act.
2. Criminal Petition No. 9387 of 2012 is filed by A-3, Criminal Petition No.
2099 of 2013 is filed by A-2 and Criminal Petition No. 10622 of 2013 is filed by A- 1.
3. Inspector of Police, Saroornagar Police Station after completion of investigation filed charge sheet against these petitioners for alleged offence under section 498-A and 506 IPC and section 3 and 4 of Dowry Prohibition Act.
4. Heard both sides.
5. Advocate for petitioners submitted that there is likelihood of settlement between the parties and on that ground sought time.
6. As seen from the proceedings sheet, the same representation is made on 14/03/2014 and from that date onwards on the same ground time is taken.
7. Second respondent is the wife, on whose complaint Police investigated the case and filed charge sheet. Now CC.No.102 of 2011 is pending before trial court and as per the submissions of both sides charges are not framed. If really parties are interested in settling the case they can as well do that even before trial court and the trial court can consider the same. Therefore, without going into merits, these criminal petitions are disposed of directing both parties to urge these grounds before trial court and that trial court shall consider the same and decide on merits. If the parties wants to settle the dispute they can as well file a petition to compound the offence or report the court to refer it to Lok Adalat since section 498-A of IPC is compoundable.
8. Accordingly, these Criminal Petitions are disposed of.
9. As a sequel, miscellaneous petition if any, pending in these Criminal Petitions shall stand closed.
