The limited grievance of the petitioner is that the third respondent police have not granted permission to the petitioner to erect Dr.B.R.Ambedkar Auto Drivers and Owners Welfare Association name board, at the end of Gandhi Park, Anguchettipalayam, Panruti Taluk, Cuddalore District.
2.Learned Additional Public Prosecutor, on instructions submitted that there is a splinter group of auto drivers, attached to the same auto stand who were objecting to erect the board and even if permission is granted, there could be a clash between the two groups. It is also stated that the place in which the petitioner seeks permission to erect the board is very congested and would cause traffic congestion. The decision to grant permission is purely vested with the respondent police on the ground reality and also taking into account the various factors including possibility of a law and order problem.
3.Hence, the petitioner is granted liberty to approach the third respondent police seeking for permission and on receipt of the same, the third respondent shall pass appropriate orders on merits and in accordance with law after giving due opportunities to all the persons concerned who may be involved/affected by granting of such permission. This Court also makes it clear that it is left open to the respondent police to impose any terms and conditions or give alternate place for the erection of the name board. Such exercise shall be completed within a period of six weeks from the date of receipt of a copy of this Order.
4.The Criminal Original Petition stands disposed of, with the above directions.
