Crl.O.P.No.11295 Of 2017 vs The Superintendent Of Police

Madras High Court|01 August, 2017

JUDGMENT / ORDER

This petition is filed praying for a direction to the second respondent police to grant police protection to the petitioner for harvesting the Savukku trees in his lands based on the compliant given on 02.02.2017 and consequently take appropriate action as per law against the accused persons.
2.Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor appearing on behalf of the respondents.
3.The petitioner has the benefit of an interim order restraining the defendants from interfering with the peaceful possession of the property comprised in S.No.198/1 to the extent of 0.83.0 acres in Patta No.664 situated at Apprampattu, Vanur Taluk, Villupuram District. The sixth respondent herein has challenged the said interim order in C.M.A.No.1 of 2017 on the file Sub Court, Dindivanam and the same is stated to be pending. In this background, the petitioner has given a representation to the first respondent seeking for police protection to harvest the Savukku trees in the subject land. When the injunction sought for has already been challenged by the sixth respondent, it would not be appropriate for this Court to direct the police to give protection in order to implement the interim order. Further, the petitioner's representation seeking for police protection is pending before the first respondent. Hence, I am of the view that the ends of justice would be meet, if the first respondent is directed to consider the representation seeking for protection.
4. In view of the above, there shall be a direction to the first respondent to consider the petitioner's representation dated 02.02.2017 seeking for police protection and pass appropriate order on its own merits.
5. Such exercise shall be completed within a period of two weeks from the date of receipt of a copy of this order and the first respondent M.S.RAMESH.J, smi shall give due opportunity to the sixth respondent also before taking a final decision on the petitioner's representation.
6. With the above observation, this Criminal Original Petition is disposed of.
