ORDER:
This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973, seeking to quash the proceedings in C.C.No.492 of 2012 on the file of Additional Judicial First Class Magistrate,Amalapuram, East Godavari District.
A charge sheet came to be filed against the petitioners/A-2 to A-4 along with another accused for the offences under Sections 498-A r/w.34 IPC and Sections 3 and 4 of Dowry Prohibition Act. The averments in the complaint show that the petitioners are parents and sister of A-1 respectively. The marriage of information took place with A-1 on 24-02- 2007 at Sri Venkateshwara Swamy Temple in Amalapuram. At the time of marriage Lws 2 and 4 have given an amount of Rs.3,00,000/- as dowry, gold jewels wg. about 5 sovereigns and silver vessels wg. about ½ kg towards dowry. After the marriage both of them lived happily for a period of three years. Thereafter disputes arose between them. It is stated that A-1 addicted to bad vices and he along with A-2 to A-4 started harassing the informant by touching her infertility. The averments in the charge sheet also show harassment in the hands of petitioners in demanding additional dowry. In respect of the above allegations, a case in Cr.No.64 of 2012 of Upplaguptam Police Station was registered against A1 to A-4. Police investigated into the matter and filed charge sheet against them.
As stated above, the present application is filed by A-2 to A-4 seeking quashing of proceedings. Though, the present application is filed for quash of proceedings, learned counsel submits that the presence of petitioners/A-2 to 4 may be dispensed with as they are residents of Hyderabad. It is difficult for them to attend the Court at Amalapuram for every date of adjournment. He further submits that presence of the petitioners before the said Court is not necessary on every date of adjournment.
A perusal of the material placed before the Court would show that police after investigation filed charge sheet in the Court of Additional Judicial First Class Magistrate at Amalapuram. The petitioners/A-2 to A-4 are residents of Hyderabad. Since there is no dispute with regard to identity of the accused, the presence of petitioners on every date of adjournment may not be necessary.
Accordingly, the Criminal Petition is disposed of dispensing with the presence of petitioners in C.C.No.492 of 2012 on the file of Additional Judicial First Class Magistrate at Amalapuram, except on the dates when their presence is specifically required by the Court.
As a sequel thereto, Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
